Plant Warranty (Items Picked Up in Person, Delivered to Property, or Installed by the Customer)
Plant material is guaranteed to be true to name and in good condition at time of pickup or delivery. Acceptance of our nursery stock at time of sale or delivery implies that the buyer agrees that the stock is in good health. We offer NO additional guarantee and accept no responsibility for plant damage resulting from poor care received after leaving the garden center. We offer no warranty for the productiveness or life of the nursery stock and cannot be held responsible for unfavorable or improper results of customer handling, neglect, planting, transplanting, maintenance, pruning, watering, fertilizing, insecticidal use, fungicidal use, herbicidal use, soil conditions, environmental conditions, extreme weather conditions, water bans/restrictions, excessive drought, salt damage, insect damage, fungus damage, virus damage, bacteria damage, animal damage, human damage, or for any other condition beyond our control. Also, we do not guarantee any plant not planted in the ground.
We do offer an option for those of you who would prefer a homeowner guarantee. We have partnered with Pennsylvania Pride®. Any Pennsylvania Pride® plant purchased from Wildwood that has a 3 Year Homeowner Guarantee tag will be backed by a 3-year Homeowner Guarantee directly from the grower. If you have any questions about the health of a plant please notify us as soon as possible. Plants may not be returned or exchanged for another after time of purchase. All plant sales are final. Wildwood accepts no responsibility as to the suitability or placement of stock in the landscape.
In the event of delivery beyond the curb line, Wildwood assumes no liability for any damage to sidewalk, driveway or other property. Bulk mulch is delivered in dump trucks to safe, accessible locations only. Accessible locations include driveways and parking lots that are appropriately paved and have no obstructing wires, tree limbs or overhead structures in the vicinity. Wildwood refuses the right to deliver any material that our driver or staff feels is unsafe or within inappropriate reason. Please be aware that if you are having plant material or hard goods being delivered that adequate access are required for the use of a handcart, ball-carrier, or dolly. Wildwood is not responsible for any damage to walkways, patios, gardens, driveways, parking lots, or lawns as a result of transporting material across the property. Also, Wildwood may not combine all material on the same delivery. For example, there may be two separate deliveries and two separate fees for the delivery of mulch and for the delivery of plant material.
Hard Good Warranty & Return Policy
Hard goods may be returned with a receipt or proof of purchase within 30 days from the date of purchase. Returns are eligible for a merchandise credit or for reimbursement of payment using the same method of payment during the original purchase, not to exceed the purchase price. The item(s) must be unused, still in sellable and original condition, with any original packaging. Defective products can be returned with a receipt for a merchandise credit or replacement. Wildwood does not guarantee the performance or condition of any hard good item. Wildwood does not guarantee fountain pumps or any item inappropriately used or maintained. Sale, markdown, discounted or clearance items are not guaranteed. There will be a 20% service charge for returned orders that were previously assembled by Wildwood.
Items Tagged as Hold or Sold
We require a minimum non-refundable 20% deposit on in-stock plants or merchandise you wish to set aside and purchase. The balance must be paid in full at time of pickup or delivery. We define an item as ‘HOLD’ if the item has a minimum deposit of 20% of the purchase price. Any item tagged as ‘HOLD’ must be paid for in full within 7 days unless specific arrangements have been made and noted on the invoice slip at time of purchase. If the ‘HOLD’ item is not paid in full and picked up within 7 days Wildwood reserves the right to place the item back on sale. We define an item as ‘SOLD’ if the item has been paid for in full. Any item tagged as ‘SOLD’ must be picked up within 7 days unless specific arrangements have been made and noted on the invoice slip at time of purchase. If the ‘SOLD’ item is not picked up within 7 days Wildwood reserves the right to place the item back on sale. All ‘HOLD’ and ‘SOLD’ items not picked up and or paid for within 7 days of original purchase are subject to no longer receiving any compensation.
Canceled and Special Orders
Special orders exceeding a $100 purchase will require a minimum 20% non-refundable deposit or as high as a 50% non-refundable deposit depending on the delivery cost, packaging, size, amount, and type of material. Any Special orders not picked up and or paid for in full within 7 days will be considered cancelled unless other arrangements are written and documented on invoice. If, after 7 days, the item(s) are not paid for and picked up in full, Wildwood reserves the right to place the item back on sale There will be a 20% service charge for cancelled or special orders that were previously assembled by Wildwood. We do not guarantee the availability or the length of time it will take to bring in a special order. Also, there may be a minimum amount of material required for a special order to be processed.
Design Services & Referrals
Wildwood is no longer accepting or performing new installation work. However, we work with a "select" group of landscape architects, landscape designers, and landscape contractors. Depending on the type of project we are happy to refer you to someone who we feel will best assist you with your landscape needs. Please inform the "select" referral that Wildwood Nurseries, Inc. referred you to them. Provided that the "select" landscape contractor/designer purchases all plant material for your specific project through Wildwood, Wildwood will guarantee the plant material for a period of one year from the date of purchase. The guarantee is only a one-time replacement on the plant itself. Delivery or additional labor charges are extra. Upon notification from both the homeowner and "select" referral that you have entered into a business agreement/contract with one another to have the "select" referral install the plant material for you, Wildwood will guarantee the plant itself only for one year from the original date of purchase. The guarantee is on the original value of the plant itself, not on the delivery or the reinstallation of the plant. The homeowner, "select" referral’s name, guarantee agreement and date of purchase will be noted on the invoice. The guarantee can only be valid if a Wildwood employee makes note of the agreement between the purchaser and the "select" referral on the invoice. The homeowner and "select" referral must retain a copy of the receipt for one full year from the date of purchase. Remember, the guarantee applies only towards a select group of landscape architects, landscape designers, and landscape contractors. Wildwood may suggest other referrals outside of our "select" group. Wildwood will not guarantee the plant for any outside referral other than the "select" referral Wildwood prints on the invoice.
In the event that the plant dies within one year of the date of purchase it is the homeowner’s responsibility to contact and notify us. Please be willing to supply both the receipt and the dead plant for replacement. Depending on current availability, Wildwood will either replace the plant with a suitable match or issue you a credit for the amount paid for the item.
Please be aware that this guarantee is offered only to homeowners who have entered into a contract with a referred business as a result of Wildwood’s referral.
Wildwood accepts no responsibility for any referrals, including, but not limited to, payment for services or the quality of workmanship in terms of labor or design services. The homeowner is to pay the referral directly for any installation, labor, delivery or design services. Wildood reserves the right to change our "select" referral list at any time.
The homeowner may be responsible for disclosing locations of utilities, zoning restrictions, property lines, setbacks, septic plans or other requirements/restrictions set forth by the state, city, town or association. Please check with your local city or town with respect to required wetland, coastal and other permits.
Safety
The safety of children is very important to us. Due to the use of heavy equipment on our property we advise that you keep all children close at hand. Children are not allowed to ride on carts or be left unwatched by their parent or guardian at any time while on the property. Children are not allowed to climb benches or play with or around any water fountain, nursery stock or hard good item.
